Apple vs. Big Apple

The Big Apple, New York City, has created a new eco-logo for their fleet of hybrid buses and taxi cabs. It is a well designed logo based on the infinity symbol and a stem with leaf. The logo for Apple Inc. is too similar to the greenNYC logo, or so thinks the legal staff at Apple. Apple claims the new logo will cause confusion and "seriously injure the reputation which [Apple] has established for its goods and services." Based upon that claim, Apple has requested that the trademark request for greenNYC be denied.
Seem unreasonable? Maybe, but this apparently is standard practice in the patent and trademark business. A thirty day vetting period starts when the application is submitted and just about any large enterprise will challenge many trademark requests along the way. Thousands of these challenge petitions are filed with the government every year. Incidentally, New York City has been known world-wide as the Big Apple since the 1920s – fifty years before the Apple computer. Who has the case here? Somehow we think it will all work out.....
